My colleagues Brady Dennis and Dina ElBoghdady got their hands on an early version of the settlement that the country's attorney generals and a few federal agencies are hammering out with the big banks. This is the endgame to the mortgage servicing mess that dominated the news some months ago: the banks, having repeatedly broken the law while handling mortgage paperwork and conducting foreclosures, need to strike some sort of deal with regulatory authorities so they're not nipped to death by thousands and thousands of lawsuits. That means the state AGs and regulators have some leverage: the banks need relief from them, and so the question is how much relief they can get for homeowners in turn.



The hope is that they can get something capable of stabilizing the housing market. For all that the economy is improving, housing remains a huge drag, with legitimate estimates suggesting we've still got as many as 11 million foreclosures in the pipeline. "The number one reason for nervousness about the economy in the next six to nine months is the foreclosure crisis," Moody's economist Mark Zandi told me last week.



With Congress no longer interested in acting to ease the foreclosure crisis -- or, it seems, the jobs crisis -- this settlement is perhaps our last shot at stabilizing the housing market. The big thing that advocates are looking for is "principal modification": a process in which borrowers who are underwater on their homes would see the amount they owe to the bank reduced. That looks to be in the proposed settlement, but the devil is in the details -- how much does the principal get reduced by, and under what circumstances? But if you can get those details right, a lot of experts think they could provide substantial relief. "I do think principle writedown would be very effective. If you could get $20 billion in a fund, you could provide half a million in very solid modifications," Zandi says.

A group of Senators wants Obama to name a new Medicare and Medicaid administrator, reports Robert Pear: "Members of Congress, including Democrats, have urged the Obama administration to search for another Medicare chief after concluding that the Senate is unlikely to confirm President Obama’s temporary appointee, Dr. Donald M. Berwick. Dr. Berwick’s principal deputy, Marilyn B. Tavenner, has emerged as a candidate to succeed him. Lawmakers of both parties said Monday that Ms. Tavenner, a former Virginia secretary of health and human resources with extensive management experience, could probably be confirmed. In a letter to the White House last week, 42 Republican senators urged Mr. Obama to withdraw the nomination of Dr. Berwick to head the Centers for Medicare and Medicaid Services."



Proposals to repeal health care reform's tax reporting provision could hurt the middle class, reports Brian Beutler: "Health care reform advocates are wise to the hidden middle-class taxes that passed the House last week, and are doing their best to kill them. The groups Families USA and Center on Budget and Policy Priorities have argued publicly against the proposal, and House and Senate Democrats have circulated memos on the Hill to raise awareness of the impact the proposal will have. As explained here, the penalties are designed to offset the cost of repealing a tax requirement on businesses...Under the House plan, if families get even modest compensation bumps after qualifying for health insurance subsidies, they can be required to reimburse the IRS with thousands of dollars."



Republicans need a health-care plan, writes Ezra Klein: "It's put-up-or-shut-up time for Republicans. They managed to make it through the health-care debate without offering serious solutions of their own, and - perhaps more impressive - through the election by promising to tell us their solutions after they'd won. But the jig is up. They need a health-care plan - and quickly."

And it’s a striking development in an at-times turbulent relationship between two hot-tempered septuagenarians who have sparred bitterly over the years."



Senate Democrats are proposing a harmful education cut, writes Cindy Brown: "The Senate Democrats countered the Republicans’ slash-and-burn H.R. 1 with their own proposal, released Friday. The measure...shortsightedly cuts $150 million from the Teacher Incentive Fund (TIF)...The program catalyzes the kinds of reforms human capital systems in our schools need. For instance, it requires participating states and districts to develop comprehensive and aligned approaches to attracting, evaluating, and developing educators. This alignment is particularly important because recent research supports the view that compensation reforms that are not combined with and aligned to other district reform strategies...are not likely to improve teacher practice or student achievement."

Some Democratic lawmakers say yes, and assert that now is the time for the United States to dip into its Strategic Petroleum Reserve, which is brimming with 727 million barrels of crude. "We encourage you to consider utilizing the Strategic Petroleum Reserve (SPR) now," Rep. Edward J. Markey and two other House Democrats said in a letter sent to President Obama on Monday... 'From my perspective, it certainly would make sense for the president to begin selling oil from the SPR,' Senate Energy and Natural Resources Committee Chairman Jeff Bingaman (D-N.M.) said Monday, citing soaring prices and fighting in Libya."

Energy efficiency measures could backfire, writes John Tierney: "A growing number of economists say that the environmental benefits of energy efficiency have been oversold. Paradoxically, there could even be more emissions as a result of some improvements in energy efficiency, these economists say. The problem is known as the energy rebound effect. While there’s no doubt that fuel-efficient cars burn less gasoline per mile, the lower cost at the pump tends to encourage extra driving. There’s also an indirect rebound effect as drivers use the money they save on gasoline to buy other things that produce greenhouse emissions, like new electronic gadgets or vacation trips on fuel-burning planes...In some cases, the overall result can be what’s called 'backfire': more energy use than would have occurred without the improved efficiency."

You may know by now that American Banker has uncovered the 27-page term sheet that could form part of a global settlement between state and federal regulators and mortgage servicers. The term sheet describes a host of actions to which the servicers would have to conform, most of which reflect current law with a couple that go a little bit further.


I’m a slight bit late to discussing this term sheet, so I’ll refer you to some other worthy commentators and analysts for the details. Cheyenne Hopkins at American Banker has a nice synopsis of the terms, as does HuffPo’s Shahien Nasiripour. Georgetown Law Professor Adam Levitin finds the terms to be strong, while Felix Salmon finds any settlement of this type to be doomed, mainly because of the lack of strong enforcement for non-compliance.


Here’s what I can add to this. This morning, there just so happens to be a field hearing of the House Oversight Committee in Baltimore. In fact, it just started at 9am ET. Rep. Elijah Cummings, who represents the area, called the hearing, which will feature the mayor of Baltimore and the Governor of Maryland, among others, to examine the foreclosure crisis and the abuse carried out by mortgage servicers. I got a chance to talk with the star witness yesterday.


His name is Sgt. Kevin Matthews, and he served in Iraq in 2005-2006. He was wounded in the line of duty and returned to the US a disabled veteran. He bought his home in 2008 and then lost his job a year later. He exhausted all of his funds to keep up with the mortgage payments, but eventually went into default. In the second half of 2009 he sought a variety of modification packages with his mortgage servicer, USAA (GMAC Mortgage actually serviced the loan, but Matthews interfaced with USAA). “I basically got the runaround,” Matthews said.


In February of 2010, Matthews received the notice of intent to foreclose within 45 days, but by then he had been approved for disability from his injuries. He had a local housing agency put in for a modification for him, reflecting this new information, in April 2010.


The crucial piece of information here is that Matthews had a VA loan. “With a VA loan, foreclosure is supposed to be the last option,” Matthews explained. “By contract, they cannot foreclose until all options are exhausted: a modification, deed-in-lieu, or a short sale.”


But instead of reacting to the new information in the modification package received in April 2010, Matthews’ servicer simply ignored it, and made good on the foreclosure sale on May 21, 2010. Under the law governing federally-funded VA loans, the servicer was to rescind that sale date as they pursued a modification. “They got the package but never pushed back the sale date,” Matthews said.


Here’s where the story takes quite a turn. Matthews was away at school on June 8, 2010, and he returned home to find the locks changed on his house. The servicer had gone into the house and taken all of his belongings out, in preparation for the foreclosure sale. This violated Maryland law, because the servicer needed to file a writ of possession to remove Matthews from the home. “They stole my stuff, stole my kid’s stuff,” Matthews said. “They took everything in the house. They took my lawn mower.”


As it turned out, Matthews had a very unique situation. His legal defense, the Baltimore-based non-profit Civil Justice, discovered that his foreclosure affidavit was signed by none other than Jeffrey Stephan, GMAC’s infamous robo-signer. After months in court, GMAC dismissed the case against Matthews and rescinded the foreclosure sale. GMAC has the ability to re-file the case, but has yet to do so thus far.


Matthews has returned to the home, where he’s still trying to obtain a permanent loan modification. He’s also still trying to get his possessions back. His lawyer, Anthony DePastina, called the phone number made available to inquire about his belongings, but nobody ever answered. The servicer, in ransacking the house, also damaged it. They broke the hot water heater and cracked a drain pipe. They stuck Matthews with all the water bills, and he also wound up with a citation for overgrown weeds on the property. “In Maryland, if a citation is not remedied, it becomes a misdemeanor,” Matthews explained. “But how can I cut the grass, they stole my lawn mower!”


Now, why do I bring up this particular servicer horror story? Mainly because this was a VA loan. And therefore, a great many of the elements of the settlement term sheet are similar to how the servicer is required to deal with a VA loan. The VA Home Loan Program spells out specifically how their products are to be treated. And still, in this case, the servicer violated the guidelines. Not only that, but they stole everything in the borrowers’ home to boot. Additionally, in this case the legal system actually worked. Matthews got his home back because of faulty affidavits. But that has not helped him get back everything he owned.


The main point is this: you can make all the guidelines you want, and basically, the 27-page term sheet has most of them. You can demand a single point of contact for borrowers, an end to the dual track process of the servicer pursuing modifications and foreclosures simultaneously, specific mandates for modifications and all the rest. You can even set stricter guidelines for dealing with military families. All of those are in the term sheet, and many of those kinds of guidelines are in the VA Home Loan that Sgt. Kevin Matthews received. It didn’t matter. Neither did all the promises servicers have made to reform their systems going back to 2003. Servicers pretty much don’t follow the law. That’s why they were under investigation. A document that tells them to comply with the law, in language the banks are already using, doesn’t seem like it’ll make much of a difference.


Two more things. Without rigorous enforcement, the guidelines are approximately meaningless. State AGs and the Consumer Financial Protection Bureau would serve as the enforcement monitors under the terms of the agreement. And CFPB adds a new wrinkle to this. However, if servicers have been abusing their customers for this long, and the term sheet mostly reinforces the same laws that they broke all this time (with a couple additional strictures), who’s to say that they won’t simply treat the Kevin Matthewses of the world the same way again?


The final issue is this. The term sheet sets the basic standards for conduct in the servicing industry that servicers should have followed all along. But this is supposed to be a sanction, for violations of law. So now the penalty for failing to follow the law is having to sign an agreement saying you’ll really follow the law this time? We don’t know what monetary penalties or quotas for principal mods will come along with this yet. But we do know this. Kevin Matthews had all his possessions stolen from him, and nobody under this agreement will go to jail for that theft.

Making Money on Ebay






Travis Salisbury was an Industrial Designer who worked for various government agencies before his retirement in 1977. In the late 1950's, Salisbury received an honorary degree in Design from the Montana Institute, and later took a job as director of design for the Montana State Legislature. This was an honorary position i.e. he didn't get paid. His main goal as a designer was to "help people get along and have fun while doing it." He organized a huge number of "supper days" events where opposing politicians would cook each others favorite meal and then eat them together. This helped Montana greatly. In 1961 he designed Chair #406 (named after Helena's area code). This chair looked completely normal except for one small feature -- a V-shape under one of the legs.



The reason for this "V" was to allow a game to be played with multiple chairs. People would play by hitting a ball through the "V" with some sort of mallet. Salisbury wanted people to be able to blow off steam in-between sessions. The "V" was large enough to let a croquet ball pass. All of the #406 chairs have since been sold off or scrapped -- people got too caught up in the game and it became a distraction.



After multiple years of writing proposals to the U.S. mint, Salisbury finally hit the big time in 1965 with his Average Citizen Quarter Program (or ACQP). The idea was simple: put an average citizen on a quarter. For a year, applications were scoured over until Randy Young, a steelworker from Pittsburgh, was selected. The coins were minted in 1967. Less than two months after the coins were minted, Randy Young was arrested for armed robbery -- the coins became known as "Jailbird Quarters." The Mint immediately stopped production of the coins, and the ones that existed were given an acid treatment to hide their features and to shame both Salisbury and Young.



After the public disgrace of the Jailbird Quarters, Salisbury moved to New Jersey and began to write textbooks for elementary school students. The only one of his books that made it very far was Learn to Control Your Machine. The art on the cover was a drawing that Salisbury's uncle drew of Travis at age ten.



The text of the book was simply "Learn to control your machine" over and over again, much like in the movie The Shining. At least five times per page there was a spelling error, 500 errors in the book. Students were graded on the amount of errors that they could find. Salisbury made sure that there were at least 100 variations of the book so that the students couldn't cheat. Some students were actually helped by the book, others were scarred for much of their lives.



After finally making money with his book, Salisbury went back out west to Montana, and got his honorary Design Director position back. This was 1973. After noticing that many of the politicians were making embarrassing and even incriminating doodles in their notebooks, Salisbury made them a custom notebook that would solve the problem. They would have the usual-sized ruled paper, but there would be a bigger column left near the binding when they tore off pages. This notebook had an area for doodles and a doodle book that the politicians could keep for later once all of the pages had been ripped off. A doodle book from the Montana State Legislature recently sold on eBay for $1000.



Salisbury worked four more years in Montana and retired in 1977. Some say that he was a pioneer and others say that he severely hurt the chances of other designers with dreams of working in government. Salisbury still lives in Montana where he's working on a new book about how the Jailbird Quarter fiasco was planned called Randy Young is Innocent.

The President has recently announced a new plan to free up huge chunks of the wireless spectrum, increase the national coverage of 4G networks, and install a wireless public safety network. These are ambitious goals being set by the administration, perhaps the most being the 4G investment which the President has pledged will cover 98% of Americans.


To make this all work, the White House is planning to raise $27 billion in spectrum auctions, and then turning that money around to fund the investment in these areas:



  • $5 billion to bring 4G internet connections to rural America

  • $3 billion for 4G research and development to coincide with the construction

  • $10.7 billion for the wireless public safety network, which was called for years ago by the 9/11 commission

  • $9.6 billion for budget deficit reduction


The push behind this investment invites comparison to the past efforts to bring telephone communication and highway travel to all corners of America, and the administration has framed it’s arguments in support of the investment in the same light. From Networkworld:


“America’s businesses are building out 4G networks to much of the nation,” the White House said in a statement. “Nevertheless, absent additional government investment, millions of Americans will not be able to participate in the 4G revolution. This investment will … extend access from the almost 95 percent of Americans who have 3G wireless services today to at least 98 percent of all Americans gaining access to state-of-the-art 4G high-speed wireless services within five years.”


Commentators have noted, however, that the entire plan hinges on the money brought in from auctions. As any eBay patron can tell you, those don’t always work out how you want. But the emphasis on bringing Internet connectivity (and public safety) to the nation as a whole, is a worthy one. Keep in mind, this isn’t so much about 4G as it is bringing the Internet to mostly poor, isolated, outlying communities. Hopefully this initiative, however it really pans out, will give every American a more equal footing in the burgeoning information economy. Perhaps it will be little things like someone making some extra money on Etsy, or bigger things like a farmer finding a better price for his crop.


Either way, it will bring us a step closer to all being united, as as a people, underneath that glorious community that truly identifies this country: Facebook. I mean, uh, the American dream.

Last night in the State of the Union address, President Obama stated that “the only way to tackle our deficit is to cut excessive spending wherever we find it—in domestic spending, defense spending, health care spending, and spending through tax breaks and loopholes. This means further reducing health care costs, including programs like Medicare and Medicaid, which are the single biggest contributor to our long-term deficit. Health insurance reform will slow these rising costs.”


Is it possible that the President has already forgotten that the health care law included a massive expansion of the broken Medicaid entitlement? According to projected national health expenditures from the Office of the Actuary at the Centers for Medicare and Medicaid Services (CMS), Medicaid spending in 2019 will be $896.2 billion. Without the health care law, CMS projects that the amount would have been $802.4 billion.


This means that the President’s health care law will increase Medicaid spending by 12 percent or about $100 billion annually. The extra spending comes from the additional 18 million or so individuals—mostly non-disabled and non-elderly adults without children—who will now have taxpayers paying their health care bills through the Medicaid program.


Two central components of the law expand eligibility to the government-run Medicaid program and offer costly subsidies to an estimated 20 million individuals to purchase health insurance. With an increasing amount of health care subsidization, taxes will increase, but so will the demand for health care services. This problem is exacerbated because there is very limited out-of-pocket payment for Medicaid. The subsidies and the increased third-party payment will cause health spending to grow, not slow.


Medicaid is a broken program for many reasons. First, national spending on Medicaid has more than quintupled over the past two decades, and about 16 percent of the population is currently enrolled. A primary reason state budgets are out of whack is this explosive Medicaid growth and states’ responsibility to finance a portion of its programs costs.


Despite the massive increase in spending, many physicians fail to participate in the program because of low payment rates and a frustrating amount of paperwork. This causes many Medicaid beneficiaries to receive basic care services in the emergency room.


There is evidence that Medicaid provides beneficiaries with a low quality of care. A recent study from the University of Virginia found that Medicaid patients have worse surgical outcomes than individuals without insurance, even controlling for a multitude of personal characteristics.


Instead of doubling down on Medicaid and its existing structure, Washington should consider major structural reform for this troubled program. To start, the open-ended federal reimbursement of state Medicaid spending, which creates perverse incentives for states to grow their programs unsustainably, must be reformed. Then, taxpayer-financed assistance should be targeted to truly deserving individuals using market-based principles that better align incentives of providers, recipients, states, and taxpayers. This is the path to put Medicaid spending on a more sustainable course.


The President should re-read his law if he believes its passage either improved Medicaid for those on it or reduced Medicaid spending growth.

Making Money Cash


Tibetan religious leader in-exile “Karmapa” Ogyen Trinley Dorje, who is likely to replace the Dalai Lama as the world symbol of Tibetan Buddhism and icon of Tibetan aspirations, is now surrounded with a serious controversy. Police in India have raided his monastery near Dharamsala, and allegedly recovered foreign and Indian currency worth nearly Rs 70 million.


Dorje, now 25, is the spiritual head of the Karma Kagyu sect of Tibetan Buddhism and has been in Dharamsala since his headline-making escape to India in January 2000, when he was only 14.


The Karmapa’s office, in a statement said, they were “complying fully with the investigation”, reports The Hindustan Times. ” ‘Our lineage and His Holiness the Karmapa enjoy the love, trust and faith of millions across the world. We have a rich history of public service made possible through financial dealings that are entirely transparent,’ the Karmapa Office of Administration said in the statement. (See here…)


Dorje has been under the Indian security agencies’ scanner since his arrival in India. He lives in Sidhbari, 10 km from the Dalai Lama’s residence. The Indian government has confined the Karmapa’s movements within 15 km of his home for sometime, and does not allow him to visit the Dalai Lama too frequently, reports The Telegraph.


” ‘On July 25, 2009, the Karmapa was given only 30 minutes to meet the Dalai Lama. Earlier, three consecutive requests from him to see the spiritual leader were turned down,’ a source close to the Dalai Lama said.


“Since July 2008, the Indian government has refused to let the Karmapa visit other monasteries in Himachal Pradesh and Jammu and Kashmir that are located close to the India-China border.


“Dorje has also been banned from travelling abroad. He had toured the US in 2008, when he visited New York and San Francisco in an attempt to raise his international profile. He is keen to visit America again but the government has not budged. (See here…)


“The Karmapa’s Z-plus security cover was withdrawn a couple of months ago; so he is now guarded by a single police constable instead of 24 security personnel. Till 2006, he was always escorted by a group of four aides but that was stopped after the security agencies objected.” More here…


Lot of speculation has begun as to the motive and timing of raiding the Karmapa’s monastery at Sidhbari. All religious orders in India receive huge donations. No one has heard so far about any other religious group being targeted. Taking action against such groups is considered a highly sensitive issue. So why the Karmapa’s monastery?


This development should please the Chinese government no end. Chinese are keen that there is no symbolic head of the Tibetan movement in exile once Dalai Lama is no more. The Indian government also knows this. Now the question is whether the Indian government has taken this drastic step in consultation with the Dalai Lama or merely on the basis of its old suspicion that the young Karmapa is a Chinese spy?


Black money is a common currency in India. The BBC reports: “A recent conservative estimate by the US-based group Global Financial Integrity Index pegs illicit capital flows between 1948, a year after Independence, and 2008, at $462bn – an amount that is twice India’s external debt. India’s underground economy today is estimated to account for half of the country’s GDP.


“Thanks to opposition and public ire over a series of corruption scandals, ‘black money’ is back in the spotlight. The Supreme Court has been chiding the beleaguered government for not doing enough to unearth illicit money. ‘Is there no basis to figure out black money?’ the court wondered on Thursday. ‘What is the source of black money, which has been stashed away in foreign banks? Is it from arms dealing, drug peddling or smuggling?’ ”


Indian politicians and power elite stand tainted in the eyes of the public with the government dilly-dallying on the issue of releasing the names of those whose ill-gotten wealth is stashed away in Swiss and other foreign banks.


One hopes that the Indian government has enough proof to hold the Karmapa guilty. Otherwise the great reputation of India, built by leaders like Jawaharlal Nehru and Mahatma Gandhi, as a sanctuary for persecuted people would be reduced to dirt.



Facebook DataMine: Sell your browsing data, make some cash.


There’s a new Chrome Extension that is allowing Facebook users to opt out of the Facebook data-mining. The extension is called Facebook DataMine, developed by Jim Haas, a Game Maker at MegaEpic.  Facbook DataMine allows my data to be mined (great pun with the name Jim).


If you need a refresher on what data-mining means, here the definition from the Facebook Data Mining Page;


Data mining, a branch of computer science and artificial intelligence, is the process of extracting patterns from data. Data mining is seen as an increasingly important tool by modern business to transform data into business intelligence giving an informational advantage. It is currently used in a wide range of profiling practices, such as marketing, surveillance, fraud detection, and scientific discovery.


In the less complicated words of Jim Haas;


Every time you use Facebook or one of the thousands of web pages using Facebook Connect your personal information is being collected and then sold to marketers and mysterious 3rd parties without your consent. Facebook gets rich and you don’t make a dime.


This extension blocks Facebook from tracking your movements on the web, which sounds great. The extension will block all data going to Facebook until it reaches 100,000 downloads. After 100,000 downloads this is where it gets strange. Facebook DataMine will then sell your information to third party websites and share the profits with you. This may excite you or in-my-case scare you. Users are able to opt out at any stage. My initial reaction was sweet, extra money, this extension is going to hit 100,000 installs fast. Then I pressed the install button and this popped up:



It made me think twice, “This extension can access: Your data on all websites…” I can’t just hand-over all that data to someone else. Then I thought some more, Facebook DataMine will let me own my data for a set time and then they will own it. Yes I will be reimbursed for selling my data. However if my data is to be sold by anyone, it should be Facebook. After all isn’t this another example of someone monetizing off the back of Facebook and leaving them out?


I trust Facebook. You’re all laughing at me right? But I do. It’s like the old saying, “better the devil you know”. Facebook launched in Feb 2004 and it took the site 5 years to become profitable. A part of me believes that Facebook should be making money for the amazing service that it is providing.


However if you want to make your data into money and have no issues with your data being sold, give Facebook DataMine a try.

It's challenging for many people to find jobs in today's economy. A chocolate quilting party may be just the ticket. Your guests can work on any sewing or craft projects that they have (many people are doing more at-home repair and craft jobs these days) while enjoying a sweet treat. Charge a $5 entry fee, put on some great music, and spend the evening having a great time with friends! Before long, you'll have a large event circle!

Buy tax liens on real estate and real property

You might be thinking that if you can't make any money because you don't have a job, you certainly don't have enough money to go buying anything—especially something as large as a tax lien! Take some time to learn about tax liens and how they can help you generate an income for years to come.

By taking out a loan to buy a tax lien, you are making a financial investment into either a piece of real estate or into a long-term income generating stream. Speak with a financial advisor about your situation to determine if buying tax liens is the best course of action for you.

Start a scrapbooking business

Photographs and mementos are precious for most people. And many people still have boxes of printed photos that are not stored digitally in their computers. Start a scrapbooking and photo scanning business through which you can help to archive peoples' favorite photos and memories. You'll have fun in the process! Your only initial start-up cost is a scanner.
